Terms of Service
ArcardeMall is a marketplace. We connect buyers, vendors and boda-boda riders in Luweero and beyond; we do not manufacture, own or sell the goods listed. Using the platform means you accept these terms.
1. Who we are
ArcardeMall is operated by Omega Nodes Company Ltd (incorporated in Uganda under the Companies Act, 2012, TIN 1058723166), registered office Luweero, Luweero District, Uganda. Contact: info@omeganodes.ai.
2. What ArcardeMall is and is not
We provide the marketplace, the payment rails and the dispute machinery. The contract of sale is between you and the vendor. The contract of carriage, where a boda-boda rider is used, is between you and that rider.
We are responsible for operating the platform honestly and for the services we run ourselves — escrow, buyer protection and dispute handling — as described in Buyer protection.
3. Your account
- You must be 18 or older and give accurate details.
- You are responsible for what happens under your account; keep your password to yourself.
- One person, one account. Accounts may not be sold or transferred.
- Tell us immediately if you suspect someone else is using your account.
4. Buying
Prices are shown in Ugandan Shillings (UGX) and include the vendor’s price for the goods. Delivery fares are quoted separately before you confirm, and you always see the total before paying.
A listing is an invitation to buy, not a binding offer. The contract forms when the vendor accepts your order. If a vendor cannot fulfil an accepted order, you are refunded in full.
Stock is decremented atomically at checkout: if two buyers reach the last item at the same moment, only one order succeeds and the other is told immediately.
5. Paying and escrow
Payments run through licensed providers (mobile money and card). Where the vendor operates on an escrow tier, your money is held by the platform and released to the vendor only once delivery is confirmed — for boda-boda deliveries, when the rider completes handover with the code you give them.
Cash on delivery, where offered, is collected by the rider and reconciled against their ledger. Please have the exact amount ready.
6. Selling
Vendors are bound by the Seller Agreement, which covers listing accuracy, KYC, commission, payouts and suspension. Riders are bound by the Rider Agreement.
7. What you may not do
- List or buy anything illegal in Uganda, counterfeit, stolen, or unsafe.
- List firearms, ammunition, wildlife products, prescription medicines or human remains.
- Manipulate ratings, run fake orders, or use another person’s payment instrument.
- Scrape, overload or probe the platform, or bypass its security controls.
- Harass, threaten or defraud another user.
8. Content you post
You keep ownership of the photos, descriptions and reviews you upload, and you grant us a licence to display them on the platform and in the marketing of the platform. You must have the right to post what you post. We may remove content that breaks these terms.
9. Suspension and termination
We may suspend or close an account that breaks these terms, that we reasonably believe is being used fraudulently, or that we are legally required to act against. Where the law and safety allow, we tell you why and how to appeal. You may close your account at any time from Your data rights; records we must keep for tax and dispute purposes survive closure.
10. Liability
Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited under Ugandan law — including your statutory rights as a consumer.
Beyond that, we are not liable for the quality, safety or legality of goods sold by vendors, and our aggregate liability for any claim connected to an order is limited to the value of that order plus any delivery fare paid.
11. Disputes
Start with our dispute process: open the order and raise a case, or write to info@omeganodes.ai. These terms are governed by the laws of Uganda and the courts of Uganda have jurisdiction. You may also contact the Uganda Communications Commission — Consumer Affairs.
12. Changes to these terms
We publish a new version number and date when these terms change. Material changes are announced in the app at least 14 days before they take effect; continuing to use ArcardeMall after that date means you accept them.
